Terms of Service - Archibite

1. Acceptance of Terms

By accessing and using Archibite ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service govern your use of the Archibite marketplace platform and services.

2. Description of Service

Archibite is a digital marketplace that enables architects and design professionals to buy and sell digital design assets including, but not limited to:

Photoshop brushes and textures
Vector graphics and illustrations
Revit families and BIM objects
ArchiCAD objects and components
CAD blocks and technical drawings
3D models and architectural elements

3. User Accounts

3.1 Account Registration

To use certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Vendor Terms

4.1 Vendor Status

Users may apply to become vendors to sell digital assets on the Platform. Vendor status is subject to approval and may be revoked at our discretion.

4.2 Commission Structure

Archibite retains a 30% commission on all sales. Vendors receive 70% of the sale price. Payments are processed monthly for sales exceeding $50.

4.3 Content Standards

All uploaded content must be original work or properly licensed. Vendors warrant that they have all necessary rights to sell the digital assets and that such assets do not infringe on third-party rights.

5. Purchases and Licensing

5.1 Purchase Terms

All sales are final. Purchases grant you a non-exclusive, non-transferable license to use the digital assets according to our Standard License terms.

5.2 Standard License

The Standard License allows you to:

Use assets in personal and commercial projects
Modify and adapt assets for your projects
Use assets in unlimited projects

The Standard License prohibits:

Reselling or redistributing original assets
Claiming authorship of the assets
Using assets in ways that compete with the original vendor

6. Intellectual Property

Vendors retain ownership of their uploaded content while granting Archibite the right to display, distribute, and market such content on the Platform. The Archibite brand, platform design, and proprietary features remain our intellectual property.

7. Prohibited Uses

You may not use the Platform to:

Upload malicious software or harmful content
Engage in copyright infringement
Violate any applicable laws or regulations
Attempt to reverse engineer or compromise platform security
Create fake accounts or engage in fraudulent activity

8. Privacy Policy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use the Platform. By using our services, you agree to the collection and use of information in accordance with our Privacy Policy.

9. Disclaimers and Limitations

The Platform and services are provided "as is" without warranties of any kind. We do not guarantee the accuracy, completeness, or quality of user-generated content. Our liability is limited to the maximum extent permitted by law.

10. Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Platform will cease immediately.

11. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify users by email or through the Platform. Your continued use of the Platform after such modifications constitutes acceptance of the new Terms.
